The Women’s Unplanned Pregnancy Support Network, as a representative of women, and the RSA Volunteer Network, as a representative of health service providers, see that Sections 301 and 305 of the Penal Code violate the constitution and have taken the following actions:

1) Exercised the right under Section 46 of the Organic Act on Procedures of the Constitutional Court, B.E. 2561, by submitting a complaint on March 8, 2018, for the Ombudsman to consider forwarding the matter to the Constitutional Court.

2) The Office of the Ombudsman sent a letter back on May 2, 2018, stating that the law has practical issues but is not yet a constitutional issue.

3) The Office of the Ombudsman suggested studying the legal issues to recommend relevant agencies to improve the law on this matter throughout the system.

4) On September 26, 2018, the two networks submitted a letter requesting the Constitutional Court to consider whether Sections 301 and 305 of the Penal Code have constitutional issues in the Kingdom of Thailand.

5) On November 13, 2018, a response was received from the Constitutional Court, with an order to accept the petition for consideration and judgment under the Constitution, Section 213, signed by Mr. Charan Phakdithanakul, Judge of the Constitutional Court.
