Many people still mistakenly believe that “abortion is illegal in all cases.” But in reality, Thailand has laws that allow women to terminate pregnancies safely and legally if they meet clear criteria.

Is abortion possible in Thailand?

The answer is: It is legally possible according to the Amendment to the Criminal Code, No. 28 B.E. 2564 if conditions are met.

What are the criteria for “possible”?

  1. Pregnancy not exceeding 12 weeks. Women can receive services voluntarily under the supervision of a doctor.
  2. Pregnancy exceeding 12 weeks but not exceeding 20 weeks. It can be done by consulting with a medical service provider or a certified expert from the Department of Health to confirm the decision to terminate the pregnancy.
  3. Other legal cases such as
    • Pregnancy resulting from rape or assault (no police report required)
    • Pregnancy affecting the physical or mental health of the pregnant woman
    • The fetus has severe abnormalities
    • The pregnant woman is under 15 years old

It’s not just “possible” but must be “done safely.”

Even though abortion is not illegal if it meets the criteria, the important thing is to receive services from a licensed medical facility, where trained doctors will provide care according to professional standards.

If unsure whether you meet the criteria, what should you do? You can start by

  • Seeking online consultation without revealing your identity
  • Checking the gestational age
  • Talking to staff to assess eligibility and appropriate options
